Terms of use for business users of the Brutlers platform
These terms apply to the use of the Brutlers platform (brutlers.com) by commercial service providers ("Vendor"). The operator is Elektronikhandel Michael Gräf, Breitscheidstraße 84, 70176 Stuttgart, Germany ("Platform Operator").
Brutlers acts exclusively as platform operator and intermediary. Contracts between couples and vendors are concluded exclusively between these parties. The platform operator does not become a contractual party.
The platform allows vendors to create a profile with portfolio, description, and pricing. Couples can contact vendors and send inquiries through the platform.
The platform operator does not guarantee any placement success. The number and quality of inquiries depend on various factors (location, category, profile completeness, reviews).
Vendors must provide truthful and complete information during registration. In particular:
The platform offers different pricing tiers: (a) Free tier with limited inquiries per month, (b) Pay-per-Lead with credit-based billing per accepted inquiry, (c) Premium subscription with unlimited inquiries.
Current prices are available on the pricing page. Credits do not expire. The platform operator reserves the right to adjust prices with 4 weeks notice.
Couples can review vendors after their wedding. Vendors have no right to deletion of reviews unless they are demonstrably untrue or unlawful.
The platform operator reviews reported reviews and removes demonstrably unlawful content.
The vendor indemnifies the platform operator against all third-party claims arising from content posted by the vendor or the provision of their services.
The platform operator's liability is limited to intent and gross negligence.
The platform operator may temporarily suspend or permanently delete vendor profiles for violations of these terms. Grounds for suspension include:
Unused credits are not forfeited upon suspension. The vendor may request a payout of remaining balance.
As this is a contract between businesses (B2B), there is no statutory right of withdrawal. Termination is possible at any time at the end of the current billing period.
Information on the processing of personal data can be found in our privacy policy. Vendors are independently responsible for GDPR-compliant processing of contact data received through the platform.
German law applies. The place of jurisdiction for all disputes is Stuttgart, Germany, insofar as the vendor is a merchant.
Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
