General Terms and Conditions — Brutlers Partner Program

1. Scope

These Terms govern participation in the affiliate/partner program of the Brutlers platform (operated by Michael Graf, hereinafter "Operator"). The partner program allows external partners (hereinafter "Affiliate") to earn commissions by referring customers.

2. Eligibility Requirements

• Minimum age: 18 years
• Trade registration or freelance activity (for regular income)
• Own website, blog, or social media presence
• The Operator reserves the right to reject applications without giving reasons

3. Commission Model

• Couple Premium (EUR 29.99): 30% one-time commission
• Vendor Subscription (Month 1): 20% commission
• Vendor Subscription (Months 2–6): 10% commission (recurring)
• Vendor Credits: 10% commission

The Operator reserves the right to change commission rates with 30 days' notice. Existing, unpaid conversions will be settled at the original rate.

4. Tracking & Attribution

• Cookie lifetime: 90 days (HTTP-only cookie)
• Attribution: First-click — the first affiliate link the customer arrives through receives the commission
• Holding period: 30 days after conversion (right of withdrawal)
• Minimum payout: EUR 25
• Payout frequency: Monthly, on the 15th of the following month
• Payout method: Bank transfer (IBAN)

5. Prohibited Methods

The following advertising methods are not permitted:

• Spam (email, comments, forums, messengers)
• Misleading advertising or false promises
• Brand bidding (Google Ads on "Brutlers" or similar brand terms)
• Cookie stuffing or automated clicks
• Self-referrals (registering/purchasing through your own link)
• Incentivized clicks (payment for clicks on affiliate links)
• Use of the Brutlers logo without permission

Violations will result in immediate suspension of the affiliate account and forfeiture of all outstanding commissions.

6. Taxes

The Affiliate is solely responsible for the proper taxation of their commission income. The Operator does not issue invoices — the Affiliate is required to issue an invoice to the Operator for the commissions received. If the small business threshold is exceeded, VAT must be shown.

7. Termination

• Either party may terminate participation at any time with 14 days' notice
• Upon termination, all confirmed but not yet paid out commissions will be transferred within 30 days
• Commissions in holding-period status forfeit upon termination by the Operator due to a breach of these Terms

8. Data Protection

The processing of personal data within the partner program is carried out in accordance with our Privacy Policy. In particular:

• Visitors' IP addresses are stored only as a hash (SHA-256, non-reversible)
• The affiliate cookie is a functional cookie (legal basis: Art. 6(1)(f) GDPR)
• Click data is deleted after 90 days
• Conversion data is retained for 10 years (statutory tax retention obligation)

9. Liability

The Operator is not liable for lost commissions due to technical failures, cookie blocking by browsers or ad blockers, or changes to the tracking system. The Operator's maximum liability is limited to the amount of outstanding commissions.

10. Final Provisions

• German law applies
• The place of jurisdiction is the Operator's registered seat
• Changes to these Terms will be announced by email with 30 days' notice
• Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected
